Short version: These Terms govern your use of xcelerate-advisory.com and our phone and SMS communications. Actual consulting and AI Front Office setup services are governed by a separate written agreement signed by both parties. You can stop text messages from us at any time by replying STOP.

1. Acceptance of Terms

By visiting xcelerate-advisory.com, submitting a contact or booking form, or calling or texting our business phone number (860.782.1125), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use this website or submit your information.

2. Website Purpose and No Professional Advice

Content on xcelerate-advisory.com is provided for general business and informational purposes only. Nothing on this website is legal, tax, accounting, or regulated financial advice, and visiting this site or booking a discovery call does not create a client relationship until we both sign a written Pilot Agreement or Client Service Agreement.

3. SMS / Text Messaging Program Terms (A2P 10DLC Compliance)

When you provide your mobile phone number to Xcelerate Advisory, the following terms apply to our text messaging program:

  1. Program Description: Xcelerate Advisory sends transactional and conversational text messages, including automatic text replies when we miss your phone call, responses to your inquiries, appointment confirmations and reminders, and customer support updates.
  2. Opt-In Consent: By calling or texting our business number, or by submitting a website or booking form with your phone number and checking the SMS consent box, you consent to receive text messages from Xcelerate Advisory at the mobile number you provided. Consent to receive marketing texts is not required to buy any goods or services.
  3. Opt-Out (STOP): You can cancel SMS messages at any time. Just reply STOP to any text message you receive from us. After you send STOP, we will send you one final text message to confirm that you have been unsubscribed. After that, you will no longer receive SMS messages from us unless you opt back in.
  4. Help (HELP): If you are experiencing issues with the messaging program, reply with the keyword HELP for more assistance, or contact us directly at rick@xcelerate-advisory.com or 860.782.1125.
  5. Message Frequency and Rates: Message frequency varies based on your calls, bookings, and interactions with us. Message and data rates may apply for any messages sent to you from us and to us from you. If you have questions about your text plan or data plan, contact your wireless provider.
  6. Carrier Liability Disclaimer: Wireless carriers are not liable for delayed or undelivered messages.
  7. Privacy: We never sell, rent, or share your phone number or SMS opt-in consent data with third parties or affiliates for marketing purposes. Please read our Privacy Policy.

4. Client Engagements and Written Agreements

All AI Front Office setups, monthly Care Plans, Pilots, Growth Diagnostics, and Growth Consulting services are governed by a separate written agreement signed by you and Xcelerate Consulting LLC d/b/a Xcelerate Advisory Services. If these website Terms conflict with a signed client agreement, the signed client agreement controls.

5. Intellectual Property and Acceptable Use

Unless otherwise noted, all text, graphics, checklists, and materials on xcelerate-advisory.com belong to Xcelerate Consulting LLC. You may view and print pages for your own internal business evaluation, but you may not copy, republish, scrape, or resell our website content without our prior written permission. You agree not to submit false information, spam our forms, or interfere with the security of this site.

6. No Guaranteed Financial Results

Business operations, lead generation, and consulting outcomes depend on your market, pricing, crew capacity, response speed, and execution. Xcelerate Advisory does not guarantee any specific number of leads, bookings, search rankings, or revenue results. Client owners review and approve all outbound templates and public claims before they go live.

7. Disclaimer of Warranties and Limitation of Liability

This website and its content are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by Connecticut law, Xcelerate Consulting LLC and its owner, employees, and contractors will not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website or our text messaging program. Our total liability for any claim related to this website will not exceed one hundred dollars ($100.00).

8. Governing Law and Venue

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of this website will be resolved exclusively in the state or federal courts located in Connecticut.
